Terms and Conditions
Please read these Terms and Conditions carefully before using this Website
Last updated: 3 May 2026
These Terms and Conditions (“Terms”) apply to the use of the website kisielowa.com and, unless otherwise agreed in writing, to services offered by Irina Kisielowa, including Russian language consulting, cultural intelligence workshops, mentality coaching, translation, editorial support, lectures, masterclasses and related educational or consulting services.
These Terms are drafted for a service provider based in Austria and are intended to reflect generally applicable Austrian and European Union requirements, including the Austrian E-Commerce Act (“ECG”), the Austrian Distance and Off-Premises Contracts Act (“FAGG”), the Austrian Consumer Protection Act (“KSchG”), the Austrian Consumer Warranty Act (“VGG”), the Austrian Civil Code (“ABGB”) and applicable EU consumer and data protection rules.
If a separate written agreement, offer, invoice, institutional contract or project-specific terms are agreed, those specific terms prevail over these Terms where they conflict with them.
1. Provider
The website and services are provided by:
Irina Kisielowa
Vienna, Austria
Website: https://kisielowa.com/
Email: irina@kisielowa.com
Additional legal notice or imprint information, where required, is provided on the website or in the relevant contractual communication.
2. Website use
The website provides information about educational, cultural, language, consulting, translation and editorial services. You may use the website for lawful, personal or professional information purposes.
You must not use the website in a way that:
- violates applicable law or third-party rights;
- interferes with the security, availability or integrity of the website;
- introduces malware, automated scraping, spam or harmful code;
- misrepresents your identity or affiliation;
- copies, republishes or commercially exploits website content without permission;
- attempts to gain unauthorised access to systems, data or accounts.
We may restrict access to the website where this is necessary for security, maintenance, legal compliance or prevention of misuse.
3. Services
The services may include, depending on the individual arrangement:
- one-to-one consultations or coaching sessions;
- Russian language instruction and professional communication training;
- cultural intelligence workshops and masterclasses;
- semester-based or multi-session programmes;
- translation, editing, localisation and stylistic review;
- preparation for meetings, interviews, lectures, briefings or cross-cultural communication;
- written materials, PDF kits, resources or other digital materials.
The exact scope, date, duration, format, language, price, payment terms and deliverables are agreed in the relevant offer, booking confirmation, invoice, email exchange or separate contract.
4. Contract formation
Information on the website, including descriptions of services and indicative prices, is not automatically a binding offer unless expressly stated otherwise. It is an invitation to request a service or submit a booking enquiry.
A contract is formed when:
- we confirm your booking or order in writing;
- you accept a written offer;
- you make a payment after receiving a corresponding offer or booking confirmation; or
- another clear written agreement is reached between the parties.
For online orders that create a payment obligation for consumers, the order process must clearly indicate the essential characteristics of the service, the total price or method of price calculation, any applicable duration or minimum commitment, and the fact that the order entails a payment obligation.
5. Prices, VAT and payment
Prices are stated on the website or in the individual offer. Unless expressly stated otherwise, displayed prices are indicative and may be subject to VAT, taxes or other legally required charges.
Where VAT applies, it will be shown according to the applicable legal requirements. If a price is stated as “plus VAT”, VAT is added at the applicable rate. If a price is stated as VAT-inclusive, no additional VAT is charged on top of that price.
Payment terms, due dates, accepted payment methods and any instalment arrangements are specified in the relevant offer, invoice or booking confirmation.
Payment providers, banks or other third-party processors may apply their own terms and privacy notices. We are not responsible for their independent processing, systems or contractual rules, except where mandatory law provides otherwise.
6. Rescheduling, cancellation and no-show
Rescheduling and cancellation rules depend on the type of service and the individual agreement.
Unless a different arrangement is agreed in writing:
- requests to reschedule should be made as early as reasonably possible;
- missed sessions or late cancellations may be charged if time has been reserved and cannot reasonably be reallocated;
- institutional workshops, group sessions, translation projects and semester-based programmes may be subject to project-specific cancellation terms;
- mandatory consumer rights remain unaffected.
Where a service cannot be delivered due to illness, force majeure, technical failure or other circumstances outside reasonable control, the parties will seek a fair replacement date or another appropriate solution.
7. Consumer withdrawal rights for distance contracts
If you are a consumer within the meaning of Austrian and EU consumer law and you conclude a distance contract with us, you may have a statutory right to withdraw from the contract within 14 days without giving reasons.
The withdrawal period generally begins on the day the contract is concluded for services and digital content, unless mandatory law provides otherwise.
To exercise the right of withdrawal, you may send a clear statement by email to:
You may use the model withdrawal form below, but it is not mandatory.
Early start of services
If you expressly request that a service begins during the 14-day withdrawal period, you may be required to pay a proportionate amount for services already provided before you withdraw.
If a service has been fully performed before the end of the withdrawal period, the withdrawal right may be lost only where the legal requirements are met, including your prior express request for early performance and your acknowledgement that the withdrawal right may be lost upon full performance.
Digital content and digital materials
For digital content not supplied on a physical medium, the withdrawal right may be lost where the legal requirements are met, including your express consent to immediate performance and your acknowledgement that this may cause loss of the withdrawal right.

8. No replacement of professional advice
The website and services are educational, linguistic, cultural, editorial and consulting services. They do not constitute legal, medical, psychological, tax, financial or other regulated professional advice unless expressly agreed in a separate written contract with a qualified professional.
Any strategic, cultural, linguistic or editorial recommendations are based on the information available at the time and on professional judgement. You remain responsible for your own decisions, communications, publications and actions.
9. No guaranteed outcomes
We aim to provide services with professional care, skill and diligence. However, learning outcomes, language progress, negotiation results, publication outcomes, career outcomes, institutional decisions, business results or similar effects depend on many factors outside our control. No specific result is guaranteed unless expressly agreed in writing.
10. Intellectual property
Unless otherwise stated, all website content, texts, concepts, teaching materials, course structures, presentations, handouts, translations, editorial comments, graphics, images, recordings and other materials are protected by Austrian, EU and international copyright and intellectual property laws.
You receive a limited, non-exclusive, non-transferable licence to use materials provided to you for your own personal or internal professional learning purposes, unless a broader licence is agreed in writing.
You must not, without prior written permission:
- copy, publish, sell, sublicense or distribute materials;
- upload materials to public platforms, repositories or AI training datasets;
- record, share or commercially exploit sessions;
- remove copyright notices or authorship information;
- create derivative commercial products from the materials.
Mandatory statutory exceptions and rights remain unaffected.
11. Materials provided by you
If you provide texts, documents, images, recordings, project files or other materials, you confirm that you have the necessary rights and permissions to provide them for the agreed purpose.
You grant us the right to use those materials only to the extent necessary to perform the requested service, unless a broader use is expressly agreed.
You are responsible for ensuring that materials you provide do not violate third-party rights, confidentiality obligations, data protection rules or applicable law.
12. Testimonials and public references
Testimonials, professional references, names, titles, images or institutional references are published only where we have a suitable legal basis and, where required, permission.
You may ask us to remove or update your personal testimonial or reference unless continued use is legally justified.
13. Confidentiality
We treat non-public information received in the course of services with appropriate confidentiality. This includes project materials, professional context, strategic concerns and personal learning needs.
Confidentiality does not apply to information that is public, independently known, lawfully received from a third party, required to be disclosed by law, or necessary to disclose for the establishment, exercise or defence of legal claims.
14. Data protection
Information about the processing of personal data is provided in the Privacy Policy available on the website. Where a specific service involves additional data processing, further information may be provided separately.
15. Third-party links and services
The website may link to third-party websites, social media profiles, institutions, payment providers, booking tools, video-conferencing tools or other external services. Such services are operated by third parties and may be subject to their own terms and privacy policies.
We are not responsible for third-party content, availability, security or legal compliance, except where mandatory law provides otherwise.
16. Accessibility
Where accessibility requirements apply, we aim to provide website and service information in a clear, understandable and accessible manner in line with applicable Austrian and EU rules, including the Austrian Accessibility Act where relevant.
If you experience accessibility difficulties when using the website or accessing information about services, please contact us at irina@kisielowa.com so that an appropriate solution can be considered.
17. Warranty and statutory rights
Nothing in these Terms limits mandatory statutory rights, including consumer rights under Austrian and EU law.
Where the Consumer Warranty Act or other mandatory warranty rules apply, those rights remain unaffected.
18. Liability
We are liable in accordance with applicable law.
To the extent permitted by law, liability for slight negligence may be limited or excluded for non-essential obligations. No limitation or exclusion applies to liability for intent, gross negligence, personal injury, mandatory statutory liability, fraudulent concealment or other liability that cannot be limited under Austrian or EU law.
Consumers retain all mandatory consumer protection rights.
19. Force majeure
Neither party is responsible for delay or non-performance caused by circumstances outside reasonable control, such as serious illness, natural events, war, civil unrest, strikes, official measures, technical outages, internet failures, platform outages or other force majeure events.
Where possible, the affected party will inform the other party and the parties will seek a reasonable solution.
20. Complaints and alternative dispute resolution
If you have a complaint, please contact us first at irina@kisielowa.com so that we can try to resolve the matter directly.
Unless mandatory law provides otherwise, we are not obliged and do not undertake to participate in alternative dispute resolution before a consumer arbitration board.
21. Changes to these Terms
We may update these Terms from time to time. The version published on the website applies from the date stated above.
Changes do not affect contracts already concluded unless the parties agree otherwise or mandatory law allows the change.
22. Governing law and jurisdiction
These Terms are governed by Austrian law, excluding conflict-of-law rules where legally permissible.
For business customers, the competent courts in Vienna, Austria, have jurisdiction where legally permissible.
For consumers, mandatory consumer protection rules and mandatory jurisdiction rules remain unaffected. If you are a consumer resident in another EU Member State, you may also rely on mandatory consumer protection provisions of your country of residence where applicable.
23. Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain valid. The invalid or unenforceable provision will be replaced by the applicable statutory rule or by a valid provision that comes closest to the economic and legal purpose of the original provision, where legally permissible.
